Diwali Fireworks Laws in Australia 2026: State and Territory Rules, Sparklers and Displays
Australia has no single fireworks law: each state and territory sets its own. Backyard fireworks are banned for Diwali almost everywhere, sparklers are lawful in some states, and Tasmania's regulations name Diwali as an occasion for a permitted display. Here is the state-by-state guide for Sunday 8 November 2026.

Diwali 2026 › Diwali fireworks laws Australia
Legal information last verified: 25 October 2026. Partly verified: the rules below are from official sources, but some points still need official confirmation (see "What we could not verify").
Quick answer: can you use fireworks for Diwali in Australia?
- Almost certainly not in your backyard. Fireworks law is made by each state and territory, and none of the rules we could confirm lets ordinary households set off fireworks on Diwali night without a permit. South Australia's consumer rule could not be confirmed.
- NSW does not authorise fireworks for retail sale to the public, Victoria allows only licensed pyrotechnicians, and Queensland has banned public use of display fireworks since 1972. - Tasmania is the only state or territory we checked whose regulations name Diwali: a fireworks display permit can be issued for a traditional cultural occasion such as Chinese New Year, Diwali or Guy Fawkes Night. Explosives Regulations 2022 (Tas), Statutory Rules 2022 No 115, as...
- The Northern Territory allows consumer fireworks only on Territory Day (1 July), not on Diwali. Territory Day (Tourism and Events NT, Northern Territory...

Diwali fireworks rules in each state and territory
Australia's fireworks laws are state and territory laws, enforced by work health and safety or dangerous goods regulators. Use the table to find your state, then open its guide for the details and the official sources.

| New South Wales | Not allowed: retail fireworks are not authorised in NSW. SafeWork NSW: Unauthorised handling of fireworks in NSW | Not confirmed | NSW |

| Tasmania | Not for households: non-pyrotechnicians may use shopgoods fireworks only under a Cracker Night permit; a Diwali display needs a permit and a pyrotechnician. Is there a Diwali exception anywhere in Australia?
Of the eight sets of rules we checked, only one names Diwali. Tasmania's Explosives Regulations 2022 list "a traditional cultural occasion (such as Chinese New Year, Diwali or Guy Fawkes Night)" as an approved purpose for a fireworks display. Explosives Regulations 2022 (Tas), Statutory Rules 2022 No 115, as... That is a display permit, not a backyard right: apart from Cracker Night, the application must nominate a pyrotechnician and be lodged at least 21 clear days before the display. Explosives Regulations 2022 (Tas), Statutory Rules 2022 No 115, as...
In Western Australia, the regulator's schedule of approved fireworks events listed a Diwali Festival display at Woodlake Sports Oval, Ellenbrook, on Saturday 24 October 2026. That shows Diwali displays going through the normal permit route, not a special exemption. WorkSafe WA (LGIRS): Schedule of fireworks events (last updated 15...
The Northern Territory's consumer fireworks window is Territory Day, from 6 pm to 11 pm, and possessing fireworks after midday on 2 July 2026 is illegal, so fireworks kept from July cannot lawfully be used on Diwali. Territory Day (Tourism and Events NT, Northern Territory...
No other regulator we checked mentions Diwali. A Diwali display everywhere else follows the same licensed-display process as any other event.
Temple and community Diwali displays
In every state and territory, a temple or Hindu community association that wants fireworks at its Diwali mela works through a licensed professional. The notice periods differ:
- NSW: a NSW-licensed pyrotechnician (or a fireworks single use licence holder) notifies SafeWork NSW and the council at least seven working days ahead, and police and the fire service two working days ahead. SafeWork NSW: Fireworks displays notifications
- Victoria: a licensed pyrotechnician gives WorkSafe, the council or shire and the fire authority at least seven days' notice. WorkSafe Victoria: Using fireworks (reviewed 18 August 2026)
- Queensland: only an authorised fireworks contractor may run the display, with at least seven days' notice. Business Queensland: Fireworks displays - notification...
- Western Australia: a licensed fireworks contractor obtains the event permit, which needs the endorsement of the local government, DFES, WA Police and CASA. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
- South Australia: a pyrotechnician's licence from SafeWork SA is needed to conduct a display. Australian Business Licence and Information Service...
- Tasmania: a fireworks display permit, applied for at least 21 clear days before, with seven clear days' notice to the fire service, police, council and neighbours. Explosives Regulations 2022 (Tas), Statutory Rules 2022 No 115, as...
- ACT: a WorkSafe ACT fireworks display permit, applied for at least 28 days before. Australian Business Licence and Information Service (ABLIS):...
Tasmania's standard permit conditions also say fireworks must not be fired within 500 metres of a church or other place of public worship without the approval of its owner or responsible authority, which matters for a display near a mandir. Explosives Regulations 2022 (Tas), Statutory Rules 2022 No 115, as...
Fire bans can cancel Diwali fireworks
Diwali falls in early November, when fire danger seasons are starting. In South Australia, the 2026/27 Fire Danger Season starts on 1 November 2026 in several districts, and during the season only the Country Fire Service can issue a permit to light a fire for a fireworks display. SA Country Fire Service: Fire Danger Season dates and permits...

HinduTone's Drik Panchang-aligned calendar lists Diwali (Lakshmi Puja) on Sunday 8 November 2026 for this region, with Dhanteras on Friday 6 November, Govardhan Puja on Tuesday 10 November and Bhai Dooj on Wednesday 11 November. Naraka Chaturdashi falls on the morning of the same day as Diwali. The dates differ from India because the tithis are calculated for local time.

What we could not verify
These points are still open. Do not treat them as settled until the official authority confirms them:
- Whether members of the public may buy or use shopgoods fireworks in South Australia; SafeWork SA's fireworks pages could not be read.
- The ACT's ban on the sale of consumer fireworks, which we could not confirm on a regulator page.
- Whether sparklers may be sold to the public in NSW, Victoria, the ACT and the Northern Territory.
- Penalty amounts in most states and territories; only Tasmania's maximum (50 penalty units) was confirmed, and the dollar value of a penalty unit was not.
- How a temple applies for a professional display in the Northern Territory.
- Which Diwali displays are approved for 6 to 11 November 2026.
Diwali fireworks safety tips for Australia
- Check your state fire service for fire danger ratings and total fire bans on the day; a ban can cancel even a licensed display. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
- Do not bring fireworks back from India or another state: products legal in one place can be unauthorised in another.
- Choose one sober adult to light everything. Light at arm's length, step back at once, and never lean over a firework.
- Check for a fire ban or dry-weather warning on the day. A ban can be announced at short notice and overrides the normal rules.
- Read the label before dark. The product category and the safety distance printed on it are the legal and practical limits for your garden or yard.
- Keep a bucket of water or a hose ready, and soak every spent firework before it goes into the bin.
- Never light fireworks indoors, on a balcony, under trees or near parked cars, and never point them at people, homes or animals.
Lawful ways to celebrate Diwali without fireworks
- Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
- LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
- Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
- Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
- Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
- Quiet celebrations: music, bhajans, a diya-lit dinner or a lantern walk on your own property avoid noise complaints and fire risk.

No. In the Northern Territory consumer fireworks can be lit only during Territory Day, from 6 pm to 11 pm, and keeping them after midday on 2 July is illegal.

Sparklers are listed as unrestricted or general use fireworks in Queensland, Western Australia, South Australia and Tasmania. We could not confirm the rule in NSW, Victoria, the ACT or the Northern Territory.

By engaging a licensed pyrotechnician or fireworks contractor, who notifies or applies to the state regulator. Notice periods range from seven days in Victoria and Queensland to 28 days in the ACT.

Important
This page is general information, not legal advice; local rules and temporary fire bans can change. Always check with the official authority for your exact address before buying or using fireworks.
Editor's note (25 October 2026): HinduTone checked the rules on this page against the official regulator pages and regulations for all eight Australian states and territories on 25 October 2026. Some regulator sites blocked our check, and those points are listed as not verified. We review this guide every year before Diwali; the next scheduled review is 15 September 2027.
