What the Western Australian rules mean for Diwali
WorkSafe WA, part of the Department of Local Government, Industry Regulation and Safety (LGIRS), is direct about private use: the public may not buy, possess, store or use fireworks. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities... There is no Diwali exception. A backyard display of rockets, fountains or crackers on Diwali night would be illegal, whether the fireworks were bought interstate or online.
What families can still use are the unrestricted items the regulator lists: bon-bons, party poppers, Christmas crackers, throwdowns and sparklers. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities... For most households that makes sparklers and diyas the centre of the evening, with the larger fireworks left to a permitted community display.
If you see fireworks being used illegally, the regulator says not to approach or confiscate them. Leave the area and call WA Police on 131 444, or 000 in an emergency. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities... Abandoned fireworks found in a public place should also be reported to the police, not handled. The Dangerous Goods Safety Branch of LGIRS assesses every application for a fireworks event permit, under the Dangerous Goods Safety Act 2004 and the Dangerous Goods Safety (Explosives) Regulations 2007. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
An organiser does not apply alone. A licensed fireworks contractor can manage the display and obtain the permit on the organiser's behalf. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities... The permit is issued only when the local government, the Department of Fire and Emergency Services (DFES), WA Police and the Civil Aviation Safety Authority all endorse it, and any of them can object. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
The contractor must tell neighbours within 200 metres of an outdoor display about its date and time, by letterbox drop, media notice or event promotion. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
Diwali displays already go through this route. The WorkSafe WA schedule updated on 15 October 2026 listed a Diwali Festival display at Woodlake Sports Oval, Ellenbrook, on Saturday 24 October 2026. Diwali 2026 dates in Australia and the fireworks rules
| Date | Day of the festival |
|---|---|
| Friday 6 November 2026 | Dhanteras |
| Sunday 8 November 2026 | Naraka Chaturdashi (morning) and Diwali / Deepavali, Lakshmi Puja (evening) |
| Tuesday 10 November 2026 | Govardhan Puja |
| Wednesday 11 November 2026 | Bhai Dooj |
HinduTone's Drik Panchang-aligned calendar lists Diwali (Lakshmi Puja) on Sunday 8 November 2026 for this region, with Dhanteras on Friday 6 November, Govardhan Puja on Tuesday 10 November and Bhai Dooj on Wednesday 11 November. Naraka Chaturdashi falls on the morning of the same day as Diwali. The dates differ from India because the tithis are calculated for local time.
In Western Australia, every day of the festival falls under the same rule: no private fireworks apart from sparklers and the other unrestricted items. If your temple or association plans a display for Diwali weekend, start with a licensed fireworks contractor well before 8 November, because the permit needs sign-off from several agencies.

What we could not verify
These points are still open. Do not treat them as settled until the official authority confirms them:
- The penalty amounts for illegal possession or use of fireworks in Western Australia.
- The application lead time and fee for a fireworks event permit.
- The text of the Dangerous Goods Safety (Explosives) Regulations 2007; the rules here are taken from the regulator's guidance.
- Whether any Diwali displays are scheduled for 6 to 11 November 2026; the schedule we read ran only to 29 October 2026.
Diwali fireworks safety tips for Western Australia
- Check DFES for a Total Fire Ban before any outdoor flame, including diyas and sparklers outside. WorkSafe WA (LGIRS): Firework displays - roles, responsibilities...
- Read the label before dark. The product category and the safety distance printed on it are the legal and practical limits for your garden or yard.
- Choose one sober adult to light everything. Light at arm's length, step back at once, and never lean over a firework.
- Keep children well back and hand them nothing that is lit. Sparklers stay hot long after the spark ends.
- Tell your neighbours in advance, especially older people and pet owners, and stop on time.
- Never light fireworks indoors, on a balcony, under trees or near parked cars, and never point them at people, homes or animals.
Lawful ways to celebrate Diwali without fireworks
- Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
- LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
- Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
- Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
- Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
- Lakshmi Puja at home: the evening puja, aarti, sweets shared with neighbours and a family meal are what most people remember about Diwali.
