Quick answer: Diwali fireworks in New Mexico
- New Mexico's permissible fireworks include ground and hand-held sparkling devices, many aerial devices and ground audible devices such as firecrackers. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
- Retail sale is allowed only in set periods: June 20 to July 6, around New Year, around Chinese New Year, September 16 and Cinco de Mayo. Diwali is not among them. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
- Cities and counties may regulate or prohibit only aerial devices and ground audible devices, not other permissible fireworks. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
- Fireworks may not be sold or used on state forest land, wildlands or a bosque. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
- Selling fireworks to anyone under 16 is unlawful. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
Cultural windows, but not Diwali
New Mexico is unusual in building cultural dates into its sales calendar: three days before and on Chinese New Year, September 16 and Cinco de Mayo, alongside the summer and New Year periods. Permanent tourism stores may sell year-round. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
Diwali is not on the list, so ordinary fireworks stands cannot sell for Diwali week. The Act sets no statewide use dates, but buying in November would have to be from a permanent tourism store.
What local governments can and cannot ban
A city or county may not ban ground sparklers, fountains and other non-aerial, non-audible permissible fireworks by ordinance. It may regulate or prohibit only aerial devices and ground audible devices. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
In a declared extreme or severe drought, cities and counties must ban missile-type rockets, helicopters, aerial spinners, stick rockets and ground audible devices, and may restrict other fireworks. NMSA 1978 Chapter 60, Article 2C Fireworks Licensing and Safety...
So for a Diwali evening in Albuquerque, Las Cruces or Santa Fe, sparklers and fountains are the most likely to be lawful, while rockets and firecrackers depend on the local ordinance and drought status.

What we could not verify
These points are still open. Do not treat them as settled until the official authority confirms them:
- Amendments made after the compiled copy of the Act we read (uploaded March 2024).
- The details of the display fireworks section.
- Local ordinances, for example in Albuquerque and Santa Fe.
Diwali fireworks safety tips for New Mexico
- Check for a fire ban or dry-weather warning on the day. A ban can be announced at short notice and overrides the normal rules.
- Keep children well back and hand them nothing that is lit. Sparklers stay hot long after the spark ends.
- Tell your neighbours in advance, especially older people and pet owners, and stop on time.
- Keep a bucket of water or a hose ready, and soak every spent firework before it goes into the bin.
- Keep diyas and candles away from curtains, rangoli powder piles, saris and dupattas, and never leave a lit diya unattended.
Lawful ways to celebrate Diwali without fireworks
- Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
- LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
- Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
- Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
- Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
- Lakshmi Puja at home: the evening puja, aarti, sweets shared with neighbours and a family meal are what most people remember about Diwali.
