Are Diwali Fireworks Legal in Texas? 2026 County Sales Period and City Bans
Texas is one of the few US states whose fireworks law names Diwali, but only as an optional retail sales period that a county commissioners court must approve. It is not a right to use fireworks, and city bans still apply. Here is how it works in 2026.

Under the Texas Occupations Code, the statewide retail fireworks seasons are June 24 to midnight July 4 and December 20 to midnight January 1. A commissioners court may add extra county sales periods, and one of them is tied to Diwali: beginning five days before the first day of Diwali and ending at midnight on the last day of Diwali. If your county approves it, licensed retailers may sell fireworks during Diwali. It does not override a city ban: if your city prohibits fireworks, buying them during a county sales period does not make it legal to set them off inside city limits.
The law does not define the first or last day of Diwali, and counting can vary. Check your county commissioners court order for the exact 2026 dates it uses.

What we could not verify
These points are still open. Do not treat them as settled until the official authority confirms them:
- Which of two conflicting 2025 versions of the statewide sales-period section controls (a June 14 to 19 period or a Lunar New Year period).
- A statewide minimum age for consumers to use fireworks.
- Which Texas counties have approved a Diwali sales period for 2026.
Diwali fireworks safety tips for Texas
- Read the label before dark. The product category and the safety distance printed on it are the legal and practical limits for your garden or yard.
- Never light fireworks indoors, on a balcony, under trees or near parked cars, and never point them at people, homes or animals.
- Keep diyas and candles away from curtains, rangoli powder piles, saris and dupattas, and never leave a lit diya unattended.
- Buy only from a licensed or registered seller in the jurisdiction where you will use the fireworks, and keep the packaging so the product category and instructions stay with it.
- Check for a fire ban or dry-weather warning on the day. A ban can be announced at short notice and overrides the normal rules.
Lawful ways to celebrate Diwali without fireworks
- Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
- LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
- Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
- Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
- Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
- Quiet celebrations: music, bhajans, a diya-lit dinner or a lantern walk on your own property avoid noise complaints and fire risk.

Frequently asked questions
Does Texas law allow fireworks on Diwali?
Texas names Diwali only as an optional fireworks sales period that a county commissioners court may approve. It is not a statewide right to use fireworks; city bans and county rules still decide where you can set them off.
Can I set off fireworks in Houston or Dallas for Diwali?
Check your city ordinance. Texas law lets cities prohibit or further regulate fireworks, and a county Diwali sales period does not override a city ban.
When is the Texas Diwali fireworks sales period in 2026?
If your county approves it, it runs from five days before the first day of Diwali until midnight on the last day of Diwali. The law does not define those days, so check your county's order.
Can a Texas county ban rockets for Diwali because of drought?
Yes. During drought a commissioners court may restrict skyrockets with sticks and missiles with fins in unincorporated areas; for the Diwali season the order must be adopted by 15 days before Diwali begins.
How far from a temple must fireworks be in Texas?
You may not ignite fireworks within 600 feet of a church, hospital, licensed child-care centre or school without written authorisation.
