Quick answer: Diwali fireworks in Nebraska

Why you cannot buy fireworks for Diwali in Nebraska

Neb. Rev. Stat. 28-1249 limits retail sales of consumer fireworks to June 24 to July 5 and December 28 to January 1 each year, and only within incorporated cities or villages. Neb. Rev. Stat. 28-1249 - Retail sale of consumer fireworks; dates

Diwali week in 2026, 6 to 10 November, falls between those periods, so Nebraska retailers cannot sell to you. Do not bring display-grade fireworks in from elsewhere: possessing or discharging anything other than consumer fireworks is unlawful.

Consumer fireworks only

Nebraska defines consumer fireworks as devices that meet federal CPSC rules in 16 C.F.R. parts 1500 and 1507 and are tested and approved; 1.4G explosives are consumer fireworks. Neb. Rev. Stat. 28-1241 - Fireworks definitions

Violating sections 28-1244 to 28-1249 is a Class III misdemeanor. Neb. Rev. Stat. 28-1250 - Prohibited acts; penalties

Temple and community displays

A public display of display fireworks requires a permit from the State Fire Marshal, with a $100 fee. Neb. Rev. Stat. 28-1239.01 - Fireworks display; permit required

Start early and use a licensed operator if your temple or association wants a Diwali display, and confirm the city's own requirements as well.

What we could not verify

These points are still open. Do not treat them as settled until the official authority confirms them:

  • Whether, and how far, cities and counties restrict or ban fireworks use.
  • Age rules for buying fireworks.
  • Any statewide use dates or hours.
  • The State Fire Marshal's fireworks web page loaded without useful content when we checked.

Diwali fireworks safety tips for Nebraska

  • Buy only from a licensed or registered seller in the jurisdiction where you will use the fireworks, and keep the packaging so the product category and instructions stay with it.
  • Check for a fire ban or dry-weather warning on the day. A ban can be announced at short notice and overrides the normal rules.
  • Keep children well back and hand them nothing that is lit. Sparklers stay hot long after the spark ends.
  • Read the label before dark. The product category and the safety distance printed on it are the legal and practical limits for your garden or yard.
  • Keep a bucket of water or a hose ready, and soak every spent firework before it goes into the bin.

Lawful ways to celebrate Diwali without fireworks

  • Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
  • LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
  • Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
  • Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
  • Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
  • Quiet celebrations: music, bhajans, a diya-lit dinner or a lantern walk on your own property avoid noise complaints and fire risk.
