Diwali fireworks laws USA › North Dakota

Legal information last verified: 25 October 2026. Partly verified: the rules below are from official sources, but some points still need official confirmation (see "What we could not verify").

Quick answer: Diwali fireworks in North Dakota

North Dakota Century Code 23-15-01 lists what retailers may sell: star lights, helicopter flyers, cylindrical and cone fountains, wheels, illuminating torches and coloured fire, sparklers, small comets or shells without an audible effect, soft shell firecrackers and whistles without report, each within weight limits. Small bottle rockets are excluded. N.D. Cent. Code chapter 23-15 - Fireworks

Everything else is covered by the general ban in section 23-15-02, so check the list before you buy.

What this means for Diwali

Diwali week (6 to 10 November 2026) is outside both sale seasons, so North Dakota retailers cannot sell to you then. The chapter bars use except as it provides, and we found no statewide use dates beyond the sale periods, so do not assume that fireworks you already own can be lit on Diwali.

Local governments can also play a part: municipalities may license retailers themselves. N.D. Cent. Code chapter 23-15 - Fireworks Ask your city about any local rules on use.

Public displays

A supervised public display, such as a temple or community Diwali show, needs a permit from the city auditor, or the county auditor outside a city, applied for 15 days in advance. N.D. Cent. Code chapter 23-15 - Fireworks

Fireworks held in violation of the chapter may be seized at the owner's expense. N.D. Cent. Code chapter 23-15 - Fireworks

What we could not verify

These points are still open. Do not treat them as settled until the official authority confirms them:

  • Whether cities may restrict or ban fireworks use.
  • Any use dates or hours beyond the sale periods.

Diwali fireworks safety tips for North Dakota

  • Buy only from a licensed or registered seller in the jurisdiction where you will use the fireworks, and keep the packaging so the product category and instructions stay with it.
  • Keep a bucket of water or a hose ready, and soak every spent firework before it goes into the bin.
  • Never go back to a firework that has failed to go off. Leave it well alone, then soak it in water once it is safe to approach.
  • Keep children well back and hand them nothing that is lit. Sparklers stay hot long after the spark ends.
  • Tell your neighbours in advance, especially older people and pet owners, and stop on time.

Lawful ways to celebrate Diwali without fireworks

  • Clay diyas: a row of oil lamps at the door and windows is the heart of Deepavali and needs no permit. Stand each one on a metal plate or a tray of sand.
  • LED diyas and string lights: battery diyas are safe for balconies, dormitories, rented flats and anywhere open flames are restricted.
  • Rangoli: a coloured-powder, rice-flour or flower rangoli at the entrance welcomes Lakshmi and gives children a creative part in the festival.
  • Temple and community celebrations: most Hindu temples and community associations hold Lakshmi Puja, aarti and cultural programmes during Diwali week; check their own website or notice board for the 2026 schedule.
  • Authorised public displays: a professional display run under a permit or licence gives the family a fireworks moment without the legal risk.
  • Quiet celebrations: music, bhajans, a diya-lit dinner or a lantern walk on your own property avoid noise complaints and fire risk.

Who to contact

For displays, contact your city auditor (or county auditor outside a city). Retailer licences come from the county sheriff unless your municipality licenses retailers; distributor licences come from the North Dakota State Fire Marshal. For an emergency, call 911.
